Bates White is pleased to announce the promotion of three individuals to Partner: Pauline Kennedy, Angela Rockwell, and Zenon Zabinski.

Pauline Kennedy has been with Bates White for 20 years. She excels in economic analysis of competition policy issues, including the effects of both horizontal and vertical mergers, monopolization, and collusion. Her work has spanned a variety of industries, including payment cards, pharmacy benefit management, tobacco, airlines, cement, gambling, and pharmaceutical industries. Dr. Kennedy also has extensive expertise in complex, data-intensive matters. Recent cases include being retained as the expert in a labor dispute for the American Civil Liberties Union and support for the Federal Trade Commission’s investigation of the pharmaceutical benefit management industry. Prior to joining Bates White, Dr. Kennedy taught econometrics, microeconomics, and international economics and trade at the University of California, San Diego. She was a Visiting Scholar at the International Monetary Fund Institute and provided forecasting for the Australia and New Zealand Bank.
Angela Rockwell joined the firm in 2015 and chairs the Life Sciences Practice. Dr. Rockwell has submitted expert opinions involving statistical sampling protocols and damages extrapolation on behalf of insurers and healthcare providers. She has also assessed statistical claims and sample projections in matters related to health insurance coverage and false advertising and has estimated liability and damages in several False Claims Act cases involving major pharmaceutical companies. She has expertise related to data and statistical analysis, and she specializes in sampling and extrapolation, survey/experimental design and analysis, causation and liability analysis, and damages estimation, with a particular focus on the healthcare and insurance industries. Prior to joining Bates White, Dr. Rockwell was a statistics consultant and an education researcher for a nonprofit working on a contract with the US Department of Education.
Zenon Zabinski has been with the firm since 2014. Specializing in analysis of complex competition and antitrust issues, he has supported both private parties and government agencies in investigations and litigation across a broad range of industries including healthcare, tech, telecom, and television broadcasting. With a particular focus on the healthcare industry, Dr. Zabinski has worked on merger and monopolization matters involving payers, providers, and pharmacy benefit managers. In addition, he has performed economic analysis informing client strategy and public policy decisions. His recent work includes analyzing the proposed $40 billion semiconductor chip merger between Nvidia Corp. and UK chip design provider Arm Ltd. on behalf of the Federal Trade Commission and a study for CalPERS analyzing how that system can structure its member health benefit to better leverage competition among health plans to reduce costs while maintaining access to quality care. Dr. Zabinski’s writings have appeared in the Journal of Health Economics, American Journal of Health Economics, Antitrust Law Journal, and CPI Antitrust Chronicle.
