State of Minnesota v. Associated Medical Assurance Ltd.
Provided deposition testimony regarding the allocation of insurance recoveries and remediation costs on behalf of insurance companies in State of Minnesota v. Associated Medical Assurance Limited, in which matter the state of Minnesota filed a direction action against insurers under the Closed Landfill Statute for the cleanup of more than 100 landfills allegedly polluted by a policy holder. Demonstrated that coverage liability was being exported from overinsured, urban sites to underinsured rural sites and showed how to properly attribute coverage to each site. Insurers settled on significantly better terms than insurers that had already settled with the state.
