Bates White provides support for Dr. Oetker’s acquisition of McCain Foods’ frozen pizza business
In September 2014, the Competition Bureau of Canada (Bureau) cleared the acquisition of most of Canada-based McCain Foods’ North American frozen pizza business by Dr. Oetker GmbH, a German food producer. Working with Stikeman Elliott, counsel for Dr. Oetker, George Rozanski, Scott Thompson, and Slava Zayats prepared a white paper that analyzed the competitive effects of the proposed transaction as part of the regulatory filing with the Bureau in late August 2014. The transaction was cleared by the Bureau without the issuance of a supplemental information request.
Bates White previously worked on behalf of Dr. Oetker to author a white paper analyzing its concerns about the competitive effects in the frozen pizza market arising from the merger of Sadia and Perdigȧo to form Brasil Foods. In a decision that Brazilian competition authorities deemed their biggest-ever intervention, the merger was approved after certain restrictions were imposed.
