UnitedHealth Group acquisition of DaVita Medical Group
A team led by Cory Capps provided support to UnitedHealth’s health services subsidiary Optum in its acquisition of DaVita Medical Group, one of the nation’s leading independent medical groups, with operations in six states. The Bates White team assisted with presentations and submissions to the Federal Trade Commission (FTC) and several state attorney general offices addressing potential horizontal and vertical concerns arising from the proposed transaction. Also provided support with responses to the FTC's second request. The investigation closed on June 19, 2019, when the FTC approved the transaction after 18 months’ review culminating in a divestiture in Southern Nevada, but allowing the transaction to proceed in five other states. Separately, the Colorado Attorney General reached an agreement with short-term conduct remedies in Colorado Springs.
