Bates White testifies on behalf of FTC in largest proposed US grocery merger

Nicholas Hill testified in September 2024 on behalf of the Federal Trade Commission and plaintiff states in the Federal Trade Commission et al. v.  Kroger Company & Albertsons Companies, Inc. preliminary injunction hearing in federal court in Portland, OR. The proposed merger would have been the largest supermarket merger in US history. A federal judge, the Honorable Adrienne Nelson, blocked the $25 billion merger, citing concerns over its likely impact on grocery competition, and favorably citing Dr. Hill’s analysis and testimony. Prior to the trial, Dr. Hill participated in a day-long economics tutorial session requested by the court.
