This CLE program will detail the history and impact of the Oregon Supreme Court's Alfieri v. Solomon decision, which answered the issue of first impression: to what extent do the confidentiality provisions of Oregon's mediation statutes prevent a client from offering evidence of attorney communications in a subsequent malpractice action against the attorney?
Moderated by mediator Richard Spier, a panel comprising Joseph Arellano and Mark McCulloch will offer diverse perspectives and analysis of this landmark case, with the insights not only of counsel for both plaintiff and defense in malpractice actions, but also from a mediator's point of view as well. Topics will include: (a) the holding in Alfieri and its impact on Oregon lawyers and their clients; (b) confidentiality rules before, during, and after mediation; (c) best practices for lawyers advising their clients before, during, and after mediation; (d) uncertainties after Alfieri; and (e) possible ethical obligations imposed by Alfieri.
