Mr. Nudelman and Mr. Natale will lecture on two topics during this program:
Distinguishing between Construction Defects and Failures
- Defining defects
- Causes of defects: problems with design, materials and/or construction
- Identifying design and construction practices that could increase/decrease the likelihood of defects
- Defining failures
- Causes of failures: deterioration, unintended use, “Acts of God”
- Identifying practices that can increase/decrease the likelihood of failures
Examining Common Defects and Failures
- Analyzing defects and failures for methodology and causality
- Site selection and engineering
- Building design
- Foundation design and construction
- Design and construction of floors, walls and roofing
- Exploring defects and failures in mechanical and electrical systems
Other program segments will focus on adopting practices that reduce defects and failures, and preventing and resolving disputes generated by defects and failures.
Chair of the firm’s Construction Contracting & Risk Management Practice Group, Mr. Nudelman is a partner in the firm’s Litigation and Real Estate Departments. He concentrates his practice in construction law. For over 25 years he has represented members of the construction industry across a broad spectrum of matters. On the transactional side, Mr. Nudelman works with owners and developers, construction managers, general contractors, subcontractors and design professionals to prepare and negotiate contract documents for construction in the New Jersey and New York metropolitan area. His construction contracting work helps his clients manage the risk inherent in construction projects so they may adequately protect their interests now to avoid claims and disputes in the future.
An associate in the firm’s construction, litigation and real estate practices, Mr. Natale concentrates on commercial litigation, business torts, shareholder and partnership disputes, breach of contract actions, construction disputes, municipal litigation, real estate and land use litigation, employment disputes, and the defense of professional liability actions. His work encompasses all aspects of pre-trial, trial, chancery and appellate litigation at both the state and federal levels, as well as in private arbitration and administrative law forums. He provides representation to a diverse range of clients, including large and middle market businesses, entrepreneurs, real estate developers, construction contractors, professional services firms and local government entities.
