Michael Toner Discusses FEC Rules Governing Campaign Funds of Deceased Candidates
Michael E. Toner, co-chair of Wiley Rein’s Election Law & Government Ethics Practice, was quoted in an October 6 National Journal article about federal campaign finance rules that govern the remaining campaign funds of deceased candidates.
The funds can be spent in only a few select ways, which are determined solely by a deceased candidate’s campaign treasurer, according to the article. The campaign committees of deceased candidates also must still file financial statements with the Federal Election Commission (FEC) until all of the funds have been spent.
“They understand candidates can’t take it with them,” said Mr. Toner, a former chairman of the FEC. “Even though you’ve moved on to the next life, your campaign committee still has reporting obligations.”
