FCC Seeks Comment on Revising ACP Transparency Data Collection Rules: In this Further Notice of Proposed Rulemaking (FNPRM), the Federal Communications Commission (FCC or Commission) requests comment on the statutory requirement to revise the Affordable Connectivity Program (ACP) Transparency Data Collection rules, the value of subscriber-level data, and methods of obtaining and encouraging subscriber consent. Comments are due February 13, and Reply Comments are due February 27.

FCC Seeks Comment on Broadband Labeling Requirements: In this FNPRM, the Commission requests comment on adjusting the broadband consumer labels to include more comprehensive information, including “pricing information, bundled plans, label accessibility, performance characteristics, service reliability, cybersecurity, network management and privacy issues, the availability of labels in multiple languages, and whether the labels should be interactive or otherwise formatted differently so the information contained in them is clearer and conveyed more effectively.” Comments were due January 17, and Reply Comments are due February 14. Additionally, Petitions for Reconsideration have been filed in the proceeding. Oppositions to the petitions are due February 15 and replies to an opposition are due February 27.

FCC Seeks Comment on Rules to More Precisely Route Wireless 911 Calls: In this Notice of Proposed Rulemaking (NPRM), the Commission requests comment on proposed rules to require wireless carriers and covered text providers to implement location-based routing for 911 calls and texts nationwide. The NPRM also proposes to require Commercial Mobile Radio Service (CMRS) and other covered text providers to deliver 911 calls, texts, and associated routing information in Internet Protocol (IP) format. Comments are due February 16, and Reply Comments are due March 20.

FCC Seeks Comment on Strengthening Data Breach Rule: In this NPRM, the Commission requests comment on its proposal to expand the Commission’s definition of “breach” to include inadvertent disclosures of customer information and to adopt a harm-based trigger for breach notifications. The Commission also proposes to eliminate the mandatory waiting period before notifying customers and instead require carriers to alert customers of customer propriety network information (CPNI) breaches without unreasonable delay after the discovery of a breach. Comments are due February 22, and Reply Comments are due March 24. Read more here.

FCC Opens Broadband Data Collection Window: The Commission released a Public Notice in which the Broadband Data Task Force announced that the second Broadband Data Collection filing window for submitting broadband availability and other data as of December 31, 2022, will open this year. The window opened on January 3 and closes on March 1.

NIST SP 800-55 Proceeding: The National Institute for Standards and Technology (NIST) is seeking comment on its initial working draft of SP 800-55 Rev. 2, Performance Measurement Guide for Information Security. Comments are due February 13.

NIST CSF Revision Workshop and In-Person Working Sessions: The National Institute of Standards and Technology (NIST) is hosting the second workshop for its series, “Journey to the NIST Cybersecurity Framework (CSF) 2.0” on February 15 and the related in-person working sessions on the same topic on February 22-23. NSTAC Meeting: The President's National Security Telecommunications Advisory Committee (NSTAC) will hold a public meeting on February 21. More information can be found here.

NIST AI Risk Management Framework Proceeding: On January 26, NIST released the draft NIST AI Risk Management Framework (AI RMF) AI RMF 1.0 and its companion resource, the AI RMF Playbook. NIST is seeking comment on the Playbook, and Comments are due February 27.

NIST Forum: The Federal Cybersecurity and Privacy Professionals Forum, sponsored by NIST, is holding its quarterly meeting February 28. More information will be available here.

February 27: TMT partner Amb. David A. Gross will be speaking at the MWC Barcelona session titled “Where Will 5G Take Us Next?” This panel will discuss 5G acceleration, connectivity, mobile edge computing, IoT, and AI.

Wiley was honored with the 2022 ‘Law Firm Diversity Award’ from Dell Technologies, in recognition of the firm’s dedication to promoting diversity, equity, and inclusion in the legal profession.
