Overview

The federal government has embarked on a once-in-a-generation initiative to invest over $1 trillion to improve the nation’s infrastructure and foster domestic R&D and manufacturing capabilities in a broad range of industries, including semiconductors, clean energy, broadband, and other high-technology sectors. This historic initiative is the result of several pieces of landmark legislation – the Bipartisan Infrastructure Law (BIL), the Inflation Reduction Act (IRA), and the CHIPS and Science Act (CHIPS Act) – which created hundreds of new infrastructure programs across dozens of federal agencies. Wiley’s multidisciplinary team of Government Contracts; International Trade; National Security; Telecom, Media & Technology; and Environment & Product Regulation attorneys work with clients on a broad range of issues that arise under these programs – from identifying funding opportunities, to negotiating contracts and other agreements, to navigating the unique compliance obligations that apply to recipients of infrastructure funding. We counsel clients on country of origin restrictions that apply to federal infrastructure programs, including the Build America, Buy America Act (BABA) provisions of the Bipartisan Infrastructure Law, as well as the Buy American Act (BAA), Trade Agreements Act (TAA), and other domestic content restrictions that apply to federal construction contracts.
