Overview
The federal government has embarked on a once-in-a-generation initiative to invest over $1 trillion to improve the nation’s infrastructure and foster domestic R&D and manufacturing capabilities in a broad range of industries, including semiconductors, clean energy, broadband, and other high-technology sectors. This historic initiative is the result of several pieces of landmark legislation – the Bipartisan Infrastructure Law (BIL), the Inflation Reduction Act (IRA), and the CHIPS and Science Act (CHIPS Act) – which created hundreds of new infrastructure programs across dozens of federal agencies. We counsel clients on country of origin restrictions that apply to federal infrastructure programs, including the Build America, Buy America Act (BABA) provisions of the Bipartisan Infrastructure Law, as well as the Buy American Act (BAA), Trade Agreements Act (TAA), and other domestic content restrictions that apply to federal construction contracts.
