Overview
Amundsen Davis’s real estate team assisted our client in acquiring a 40-acre tract of ground in unincorporated St. Charles County and rezoned same for residential development containing 38 homes against significant public opposition. County ordinance required planned streets to connect to public streets on adjoining properties, leading neighbors to oppose the development because of concerns over cut-through traffic. We negotiated a development agreement with the county that permitted the client to create a common ground strip between the existing public road and ingress street for the development with a gate placed on this strip and easement to police, fire and emergency responders. The county ordinance did not allow gates in public right of way; hence, the need to create the common ground strip. We separately negotiated a set of covenants with the adjoining subdivisions to address their issues.
