Overview
Handled a matter involving allegations that the plaintiff was injured as a result of being criminally charge for the murder of her paramour. Plaintiff was a longtime resident of the building which had a policy of requiring all guests to sign in at the security desk. In addition, the security guard was to call up to the resident advising of guest arrival so that the resident could permit the guest to proceed to the apartment. Security was aware of a history of domestic violence between the plaintiff and her boyfriend. It is alleged that the security guard did not require the boyfriend to sign and did not call the plaintiff to permit him access to her apartment. As a result, a domestic dispute started and ended in the death of the paramour when he allegedly fell on a sharp object during the fight. The plaintiff was charged with murder, but her criminal case was dismissed by the prosecutors allegedly based on her defense of self-defense.
