Overview
Amundsen Davis obtained dismissal with prejudice of negligence and premises liability counts on behalf of its municipality client defendant in Cook County, IL. The plaintiff claimed that he was a spectator at a sporting event and participated in an activity during a break in the event. The defendant argued that under the Tort Immunity Act, the subject activity which took place during the break qualified as a hazardous recreational activity. The court, after reviewing the briefs, issued its ruling granting the defendant’s motion to dismiss.
