Overview
Amundsen Davis represented an on-call physician who was sued for allegedly failing to diagnose a cardiac condition, leading to a patient’s death. During discovery, we elicited favorable testimony across multiple depositions establishing that while the doctor was on call, she was never contacted regarding this patient. Although the physician had later performed an overread of the patients’ EKG as part of quality assurance measures, we successfully obtained a directed verdict in favor of the physician at trial, in which the court agreed that no physician-patient relationship existed between our physician and the plaintiff. The directed verdict was upheld on appeal.
