Overview
Michael Barnes secured summary judgment for an exterior construction contractor from a lawsuit brought by a townhome owner who slipped and fell on ice that formed from runoff from gutters and downspouts on the home. Michael argued that his client, the exterior contract who installed the gutters and downspouts, merely installed the gutters and downspouts per the design provided by the general contractor for the project. The court agreed and entered summary judgment for Michael’s client while allowing the plaintiffs’ claim to proceed against other defendants involved in the construction.
