Successfully Defended a Physical Therapist Accused of Being Indifferent to an Inmate's Medical Condition
Overview
Amundsen Davis represented a physical therapist that treated an inmate while working at a private medical facility. The inmate brought suit for damages, pursuant to 42 U.S.C. § 1983, alleging that the therapist was deliberately indifferent to his serious medical condition. We moved to dismiss the lawsuit because the therapist was not a state actor, but a private employee, and worked with third-parties to provide evidence in support. Upon receiving the motion, the inmate voluntarily dismissed the claims against our client and another client.
