Overview
Paul Mackowski won summary judgement for an RV dealership in the District Court for the Northern District of Indiana. The plaintiffs asserted claims based on theories of breach of warranty, violation of the Magnuson Moss Warranty Act, and violation of the Indiana Deceptive Consumer Sales Act or the New York General Business Law § 349. The plaintiffs rejected the dealerships settlement offers, and the case proceeded to summary judgment. The court awarded summary judgment in favor of the dealership on all the plaintiffs’ claims resolving the case entirely in favor of the dealership.
